Kitui MCA pleads not guilty to forgery charges

Controversial Kitui Member of County Assembly (MCA) Cyrus Musyoka on Friday, February 21, 2025, pleaded not guilty to different charges he was accused of including that of defrauding the Kitui Assembly.

The Ikanga/Kyatune MCA was arraigned in Kitui Law Courts and charged with uttering another person’s motor vehicle documents with registration number KCM 760Z to read his name so as to get reimbursement for a car loan.

The complainant Rose Kavithe Ngoima is said to be the daughter of his colleague the Kitui Township MCA Ngoima Kimanzi.

According to the charge sheet on January 12, 2023, Musyoka is said to have presented the forged documents at the Kitui County Assembly claiming reimbursement of Ksh2, 212,000 million for the vehicle which he knew very well was not his.

Further, he was charged with two counts of conspiring to commit a felony contrary to section 393 of the Penal Code.

He was also charged with obtaining registration of a motor vehicle by false pretence contrary to section 320 of the Penal Code.

Additionally, he was also charged with forging a valuation report of the vehicle contrary to section 345 as read with section 349 of the Penal Code.

Musyoka was also accused of uttering false documents contrary to section 353 of the Penal Code.

He later made a false claim by a person involved in the Public Service contrary to section 100 as read with section 102 A of the Penal Code.

His defense team filed an application seeking the MCA to be released on bond which was granted.

Kitui Senior Principal Magistrate L.K Sindani released the accused on a bond of Ksh500,000 or cash bail of the same amount.

“Bond is a constitutional aspect and a right to the accused person, however the same is enjoyed subject to obligations and responsibilities on the part of the accused to attend court without fail. In the present situation I have not been availed with a sworn affidavit for me to deny bond,” Magistrate Sindani ruled.

The matter will be mentioned on March 6, 2025, for pretrial and further directions.

MCA Musyoka was dramatically arrested on Thursday, February 20, 2025, while in Nairobi for the Wiper Party MCA’s meeting and taken to Kitui Police station where he spent the night before being arraigned in court on Friday.
