
Court drama as girlfriend demands cash bail refund after fallout with detained boyfriend

Drama was witnessed at the Milimani Law Courts on Thursday, February 20, 2025, when a heated altercation ensued between an accused person Felix Mwikya and his girlfriend who demanded to withdraw a cash bail she deposited for him.
Appearing before Senior Principal Magistrate Ben Mark Ekhubi, the lady told the court that she deposited a Ksh100,000 cash bail for Mwikya to be released after he was charged with two different counts of stealing and handling stolen goods.
The lady told the court that she gave out her television worth Ksh64,000 to a shylock for the money which he was supposed to be paid back with interest.
In return, Mwikya gave her his television for her to use as he clears the money at the shylock, but the lady laments that the man did not pay the interest incurred from the loan.
Further, she accused him of harassing her after their disagreement; some of the exchange was captured in text messages.
Mwikya told court that she sent him a message reading; ‘mimi ni mjinga sana, nilijituma kwenda kukulipia hio cash bail na sikufaa kukulipia’ a statement the girlfriend refuted.
“Nilisema mimi ni mjinga kukusaidia kulipa cash bail and you are ungrateful’ your honour after that day this man harassed me even I have a mark here at the back I can show you,” the lady told the court.

Mwikya then insisted that he didn’t touch her and that the lady stormed his home and tried to stab him using a kitchen knife prompting his wife to intervene.
“She even came to my kitchen and took a knife and said ‘leo vitu ni mbili, mmoja alale Lang’ata na mwengine alale city mortuary’ of which she took the knife until my wife got hold of her and took the knife from her,” Mwikya told the court.
Earlier, the man told the court that he was unable to repay the loan interest but he was taking care of her bills, a statement the lady vehemently refuted stating that he only pays her rent and that she caters for other bills including feeding him; sending the whole court into laughter.

In the end, the court ordered the cash bail be returned to the complainant and let the accused person be locked up until he raised the same amount for cash bail.
Mwikya pleaded not guilty after he was charged with stealing a tablet worth Ksh60,000 at the Eye Clinic at Kenyatta National Hospital (KNH) contrary to section 268(1) as read with section 275 of the Penal Code.
He was also charged with handling stolen goods contrary to section 322(1) as read with section 322(2) of the Penal Code.
He was said to have dishonestly received and retained a tablet knowingly or having reason to believe them to be stolen goods on February 3, 2025.
