
Kasarani traffic cop drops charges against Ian Njoroge who was caught on camera beating him silly

Corporal Jacob Ogendo, a traffic officer based in Kasarani, on Thursday, February 20, 2025, filed an application at the Milimani Law Courts to withdraw a case against Ian Njoroge who was seen in a video assaulting him along Kamiti Road.
Appearing before Senior Principal Magistrate Ben Mark Ekhubi, Ogendo who is the complainant in the case, told the court that he made the decision to withdraw the case against Ian from a parent’s perspective.
“I decided to withdraw the matter in court because I’m also a parent and I withdraw it willingly and I was not paid anything to withdraw it,” Ogendo told the court.
During the court proceeding, a lawyer attached to the Director of Public Prosecutions (DPP) Njoki Karongo asked Ogendo whether he was aware he could not revive the case once he withdrew it which he acknowledged.
Corporal Ogendo also told the court that he was still receiving treatment for the injuries he incurred at the time of the incident.
Further, he informed the court that he was not compensated for the funds he used to seek medical attention.
He also clarified that he did not want any compensation for the funds including the phone he lost.
Senior Principal Magistrate Ben Mark allowed the application stating that it was a good move for the parties involved in ensuring the case is settled out of court.
“So, having heard from the complainant Jacob Ogenda of the desire to withdraw all the three counts in the case also pursuant to consent granted by the DPP and also guided by Article 129(2)(c) to allow out-of-court settlement I hereby allow the application,” magistrate Ben Mark ruled.
He further ordered that the bond of Ksh700,000 deposited for Ian to be out of remand be refunded.

According to the charge sheet, Ian was accused of robbery with violence contrary to section 296(2) of the Penal Code.
It is documented in the charge sheet that on June 2, 2024, Ian, with others, jointly robbed the Corporal of a battery of police communication gadgets and a mobile phone valued at Ksh50,000 after which he wounded the officer.
In another count, Ian was accused of unlawfully causing grievous harm to Corporal Ogendo contrary to section 234 of the Penal Code.
He was also accused of resisting arrest by Corporal Ogendo.
